Acceptable Use Policy / Terms of Service

This account agreement is part social contract between account holders, part acceptable use policy, and part an agreement between the admins and account holders.

Requirements

The paying account holder is responsible for knowing and understanding these polices. They are also responsible for the actions of anyone that they provide a shell or mail account to.

Account holders are required to be a member of a moderated announcement mailing list and to keep up-to-date contact information with the administrators.

Eligibility for use of Monkeycosm.net services is limited to those people personally known by the administrators.

All users of Monkeycosm.net services should comply with all applicable laws.

Payment is made in advance of using the service and is due by the first of each month. It should be paid in a form agreed upon by the account holder and the administrators. Preferred method is check.

Limitations

Any action by an account holder which hinders the ability of a Monkeycosm.net server from performing it's primary duties of providing mail and web presence for all account holders is not acceptable. This includes, but is not limited to, writing hideously ineffecient code for dynamic sites, posting gratuitously large files, or attempting to run a mailing list with tens of thousands subscribers.

Reliable mail service is considered the most important service. If it becomes necesary, other services (most notably web) will be modified to guarantee mail delivery. If it becomes necessary to modify an account holder's web presence, we will work with that account holder to resolve the issue in a way that both parties can agree to.

Account holders may not resell services Monkeycosm.net provides to them. This does not limit an account holder from running a for profit enterprise with Monkeycosm services.

Account holders are not guaranteed a certain amount of bandwidth. Monkeycosm.net is guaranteed a 1mbit network connection from our network provider. As long as average of a month's traffic (eliminating the top 5% of data points) is below that we are not charged anything extra. The administrators will implement bandwidth shaping and/or throttling to maintain this average.

Anything deemed as network or mail abuse will not be tolerated and actions will be taken to stop it (which may include disabling the offending accounts).

If an account holder goes beyond their allotment of a resource (as defined by their account level) for more than one month, they will be expected to pay the higher account level the second month if it occurs again (or the first month if they go over the initial allotment by twice). If it happens three months of five an account will be permanently upgraded to a higher account level. Warnings will be provided to account holders who are at risk of this occuring.

Backups

While Monkeycosm.net will make every effort to keep your data safe, account holders are responsible for the backup of their own data. Monkeycosm.net administrators can assist in making a backup plan if needed.

Monkeycosm.net will maintain best effort backup plans in case of major hardware or software failure.

Legal Requests and Outside Complaints

If Monkeycosm.net recieves legal papers, in regards to a hosted account or site, Monkycosm.net will immediately inform the account holder and begin to resolve the issue with them. If the account holder is unavailable and immediate action is required, the administrators will use their best judgement to take whatever actions are needed to resolve the matter until the account holder can be contacted.

Monkeycosm.net will investigate all serious complaints made against account holders. This would include allegations such as copyright infringement and network abuse. Anonymous complaints will generally not be consided serious complaints. Monkeycosm.net administrators will work with account holders to resolve the complaint in a prompt and reasonable manner.

Privacy Policy

Monkeycosm.net will not use the information you give to us except for the reasons you provided that information to us. Monkeycosm.net administrators will not look at or provide to others private information stored on our servers (this includes, but is not limited to, logs, files, or configurations) except when necessary for troubleshooting, regular systems administration, or required to for legal reasons.
